Will He Win?
Sam, a farmer from California, needs to lift a 2500 pound generator from the floor of his barn to a hayloft 15-18ft off the floor. Sam goes to Home Depot and tells a sales associate that he “needs some heavy duty rope to use on my farm” The sales associate recommends the one-inch-thick, heavy duty nylon rope and Sam buys 150ft. of it. Sam, later that day attaches the rope to the motor generator, pulls the rope through a pulley with the aid of a tractor and lifts the generator off the floor. Suddenly the rope breaks. The generator falls to the ground and hurts Sam. Sam files a suit against Home Depot for damages…. Who wins and why??

‘Sam’ did not give specifics to the Home Depot employee. Once a product leaves the store it is no longer a stores responsibility.
You purchase things and use them at your OWN discretion. How can he fault Home Depot??!!
The fault may have been his own doing.
It may have frayed from rubbing as it was lifted.
He did not have any one helping support him as he did this job so there are no witnesses.
How can he prove it is anyone else but his own fault!!!
Sam is stupid and should thank God he is still alive to whine.

what was sam doing around something being lifted anyways. who was driving the tractor. sam is stupid.
depends on the jury. if i was on the jury i would side with home depot. the farmer knew better than to use only one pulley and one rope. if he had half a brain he would have tied the generator three or four times with the rope using three or four pulleys. a true farmer would have not gone with rope but used chain. this farmer is an idiot.
not home depot fault. the farmer did not use his head.
most people would vote for the farmer so they could take money from home depot because they are a international corporation. libs hate big corporations and if i was the lawyer i would make sure everyone on the jury was a lib… but would only take the case for the money i would recieve from sam after i won the case. sam still gets nothing but an injury. i make millions. i will let sam have enough to pay for the doc bills though
to answer your question i think the lawyers are the only ones that makes out in this case. the home depot lawyers gets paid whether they are in court or not and the lawyer for sam get paid whether sam wins or not.
